Terms and Conditions

The promoter of the Professional Sleeper Dream Job (the “Dream Job”) is Sleepagotchi (“Sleepagotchi Team”), whose principal office is located at 169 Madison Ave STE 2503 New York, NY 10016, website is https://www.sleepagotchi.com. This Dream Job is conducted by Sleepagotchi Team and is not affiliated with, sponsored by, or endorsed by any third parties unless explicitly stated.

1. ELIGIBILITY

1.1 The Dream Job is open only to participants who on the date of entry are 18 years old or older, or have otherwise reached the age of majority under the state’s laws where they reside.
 

1.2 Employees of Sleepagotchi Team, those involved in the production, development, implementation, or handling of the Dream Job, and any agents acting for the above providers, prize suppliers, or any other person associated with the Dream Job, as well as their family members and persons living in the same household, are not eligible to apply.
 

1.3 Maximum one entry per person.
 

2. TO APPLY FOR THE DREAM JOB

2.1 Individuals may apply for the Dream Job by completing the application form available at https://dreamjob.sleepagotchi.com/. Applicants must submit all required information, including but not limited to a completed submission form and any additional tasks (e.g., a short video or written statement about their interest in the job), as specified on the application page.
 

2.1.1 Applicants must agree to their name, likeness, voice, image, and submitted materials being used in PR and marketing campaigns during and after the Dream Job selection process.
 

2.1.2 One Recipient will be selected by the Sleepagotchi team, based on the quality and creativity of the application, as judged by the Sleepagotchi Team.
 

2.1.3 The closing date for applications is June 3, 2025. No submissions will be accepted after this date. Sleepagotchi Team’s database tracking system is the official time-keeping device for the Dream Job.
 

2.2 There is NO ENTRY FEE AND NO PURCHASE NECESSARY TO APPLY FOR THE DREAM JOB. Any purchase or consideration given by applicants will not improve one’s chances of being selected and anyone claiming to work for our team who asks you to pay a fee will be a scam so please be aware.

3. DREAM JOB DETAILS

3.1 The selected Recipient will be hired as a Professional Sleeper, an independent contractor position with an hourly rate of $50 USD.
 

3.2 Duties include tracking sleep patterns (e.g., hours slept, quality of sleep).

 

3.3 Upon completion of the Dream Job requirements, the Recipient will receive payment at a rate of  $50 per hour, capped at a maximum of 40 hours over a one-week period. Payment will be distributed no later than ninety (90) days following completion. Any additional sleep beyond the 40-hour limit is voluntary, will not be compensated, and does not require tracking, though participants are welcome to record it if they wish.

3.4 No cash alternative to the Dream Job will be offered. The opportunity to participate in the Dream Job is not transferable.

4. SELECTION AND NOTIFICATION

4.1 Sleepagotchi Team will select one (1) Recipient from the pool of eligible applicants within 30 days of the application closing date.

 

4.2 Applicants may increase their chances of being selected by posting content on their social media channels and tagging Sleepagotchi's official accounts.

 

4.3 The Recipient will be notified by email, using the email address provided in their application, within 7 days of selection.
 

4.4 The Recipient must respond to the Sleepagotchi Team within 14 days of notification and complete any required documentation (e.g., an Affidavit of Eligibility, Liability, and Publicity Release) to claim the Dream Job. If the Recipient does not respond within this timeframe, Sleepagotchi Team reserves the right to select a replacement Recipient.

4.5 Sleepagotchi Team reserves the right to request identification to verify the Recipient’s eligibility.

5. INDEPENDENT CONTRACTOR ACKNOWLEDGMENT

5.1 The Recipient acknowledges that participation in the Dream Job is as an independent contractor. No agency, partnership, joint venture, or employee-employer relationship is intended or created by acceptance of the Dream Job.

5.2 The Recipient is solely responsible for all applicable federal, state, and local taxes, including income and payroll taxes, and Sleepagotchi Team will not withhold or pay such taxes on the Recipient’s behalf. The sums received are subject to all applicable taxes, and the Recipient is responsible for any penalties or interest.

6. LIMITATION OF LIABILITY

6.1 By applying for the Dream Job, all applicants agree to release and hold harmless Sleepagotchi Team (and any parent, subsidiary, or related entities) from any and all liability arising from the Dream Job, including but not limited to any injury, loss, or damage caused by participation or the acceptance, use, or misuse of the Dream Job opportunity.
 

6.2 Sleepagotchi Team shall not be liable for any technical failures, incomplete or incorrect applications, or other issues beyond its reasonable control, including acts of God, natural disasters, or other force majeure events.

6.3 In no event shall Sleepagotchi Team’s aggregate liability arising out of or relating to this Dream Job exceed three (3) times the amounts paid to the Recipient pursuant to the Dream Job.

7. GENERAL CONDITIONS

7.1 Sleepagotchi Team reserves the right to cancel, modify, or suspend the Dream Job at any time due to unforeseen circumstances, including technical failures or factors beyond Sleepagotchi Team’s control.
 

7.2 Sleepagotchi Team’s decisions regarding all matters related to the Dream Job, including eligibility and selection, are final and binding.
 

7.3 The Dream Job and these Terms and Conditions will be governed by the laws of the State of New York. Any disputes will be resolved individually through binding arbitration in New York, New York, under the rules of JAMS, unless otherwise required by law.

7.4 By submitting an application, applicants unconditionally agree to be bound by these Terms and Conditions.
